| The Federal Ministry of Finance has developed guidelines with the federal states regarding the tax-related cooperation and record-keeping obligations for crypto assets (such as Bitcoin). The new guidelines replace the previous guidance from 2022. For this reason, the previous wording "virtual currencies and other tokens" has been replaced with the term "crypto assets." |
Please note | Activities related to crypto assets can lead to income from all types of income (e.g., income from business operations and capital assets).
According to paragraph 53 of the letter, the following should be noted: Gains from the sale of crypto assets held as private assets may constitute income from private disposals if the period between acquisition and disposal does not exceed one year . However, gains remain tax-free if the total gains from all private disposals in the calendar year are less than EUR 1,000 .
